The purpose of this policy is to outline the procedures and responsibilities related to malpractice and maladministration at Essential Beauty Academy. Definition
Malpractice: Any act or failure to act by a staff member or student that results in harm, injury, or damage to another individual or the institution. This includes, but is not limited to, negligence, fraud, and unethical behaviour.
Maladministration: Any act of improper management or failure to follow established procedures that may affect the integrity of the educational process. This includes, but is not limited to, mismanagement of resources, failure to maintain accurate records, and inadequate supervision.
Responsibilities
Staff Responsibilities: All staff members are required to adhere to the highest standards of professional conduct. They must report any suspected malpractice or maladministration to the designated authority within the academy.
Student Responsibilities: Students are expected to conduct themselves in a professional manner and report any incidents of malpractice or maladministration they observe.
Management Responsibilities: The management team is responsible for ensuring that this policy is implemented effectively and that all staff and students are aware of their responsibilities.
Reporting Procedures
Any individual who suspects malpractice or maladministration must report their concerns to the designated officer (e.g., the Head of Academy or Compliance Officer) as soon as possible.
Reports can be made verbally or in writing. The reporting individual should provide as much detail as possible, including the nature of the incident, individuals involved, and any evidence available.
Investigation Process
Upon receiving a report, the designated officer will conduct a preliminary investigation to determine the validity of the claims.
If the claims are substantiated, a formal investigation will be initiated, which may involve interviews, document reviews, and consultations with relevant parties.
The investigation will be conducted fairly and confidentially, ensuring that all parties involved have the opportunity to present their case.
Outcomes
If malpractice or maladministration is confirmed, appropriate actions will be taken, which may include disciplinary measures against staff or students, retraining, or changes in procedures to prevent future occurrences.
The outcomes of the investigation will be documented, and the individuals involved will be informed of the results and any actions taken.
Appeals Process
Individuals who are dissatisfied with the outcome of an investigation may appeal the decision. Appeals must be submitted in writing to the management team within a specified timeframe (e.g., 14 days).
The management team will review the appeal and make a final decision, which will be communicated to the individual.
Review of Policy
This policy will be reviewed annually or as needed to ensure its effectiveness and compliance with relevant laws and regulations.
